SECTION 1 - OVERVIEW AND DEFINITIONS

Welcome to Two Ants.
The terms "we", "us" and "our" refer to Two Ants®, a registered business and trademark of Tin Can Solutions Pty Ltd atf Trend Trust (ABN: 63 823 747 590). These terms govern your use of the Two Ants® website, sub-domains, social media platforms, and the purchase of our products and services (the "Services").
The Two Ants® website is powered by Shopify, which enables us to provide the Services to you.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you must leave now and not use or access our Services.

Note: Do not return any products to the above addresses as they will not be accepted. If you need to return a product, complete the form at our support page. We will respond with a return authorisation number and postal address.

SECTION 2 - ACCESS, REGISTRATION, AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you are under 18 years of age, you must obtain a parent or guardian’s consent before accessing the site.
To use certain Services, you may be required to register an account. You agree to provide current, complete, and accurate information. You are solely responsible for maintaining the security of your account credentials. You may not have more than one active account, and your account is non-transferable. We reserve the absolute right to modify, control, or suspend accounts created under false pretences or used in breach of these terms.

SECTION 3 - OUR PRODUCTS AND DO-IT-YOURSELF CONTENT

We strive to provide accurate representations of our products; however, variations in colour, accessories, and appearance may occur depending on your screen settings. All product descriptions and availability are subject to change without notice.
Do-It-Yourself and How-To Content: Video clips, text, and photographs on our site may depict activities undertaken by qualified professionals. You agree not to attempt to replicate any activities shown unless you have checked the specific product specifications, obtained advice from qualified experts, complied with all applicable laws, and employed safe practices. The content is for informational purposes only, and we accept no liability for any injuries, losses, or damages resulting from your replication of these activities.

SECTION 4 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. An order is not accepted until we receive payment and confirm acceptance. We reserve the right to accept or decline your order for any reason, including unavailability or pricing errors.
Cancellation by Us: Prior to dispatch, we may cancel an order without liability if products are unavailable, there is a pricing error, or the order breaches these terms. You will not be charged if we cancel under these conditions, and if you have already been charged, then you will be refunded in full.
Cancellation by You: Prior to dispatch, you may request to cancel an order due to circumstances beyond your reasonable control (e.g., serious injury or illness), but not for a simple change of mind. You must provide written notice and a reason before dispatch. Orders cannot be cancelled once dispatched in our system.

SECTION 5 - PRICES, BILLING, AND TRANSPARENCY

Prices are based on Australian Dollars (AUD) which can be changed in the currency section of the site to another currency, and are calculated by Shopify’s or the selected payment processors exchange rates. Within Australia, the AUD prices are inclusive of Goods and Services Tax (GST) unless otherwise stated. International currencies do not contain taxes or duties which may be required to be paid to the receiving country's governing body before receiving the products. Prices are subject to change without notice, but changes will not affect accepted orders. We are committed to transparent pricing; all transaction-based fees are disclosed upfront, and we strictly prohibit hidden "drip pricing".
You may incur additional freight charges for special, bespoke, bulky, or express items which will be confirmed at checkout before you agree to pay. You agree to provide current, complete, and accurate payment information for all purchases.

SECTION 6 - SUBSCRIPTIONS AND RECURRING SERVICES

For any products or services offered on a subscription basis, you will be provided with clear, upfront disclosure of the term, automatic renewal provisions, and pricing. You may cancel your subscription at any time using a straightforward online cancellation method provided in your account dashboard, without unnecessary barriers or exit penalties.

SECTION 7 - SHIPPING AND DELIVERY

Delivery of products is handled by third-party couriers and Australia Post. All delivery timeframes are estimates only. For Australian orders, please allow up to ten business days for delivery before submitting an enquiry. Once we have a single tracking event proving dispatch by the carrier, the risk of loss passes to you.
International Orders: We are responsible for costs associated with exporting goods out of Australia. Once the shipment clears Australian export, our responsibility ends. Any duties, taxes, or customs clearance fees required by the destination country are the sole responsibility of the customer.

SECTION 8 - RETURNS, WARRANTIES, AND CONSUMER GUARANTEES

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality.
Unless you notify us within fourteen (14) days of the order date (and confirm in writing within 7 days of receipt), the product shall be deemed accepted. We will accept returns and provide a replacement, voucher, refund, or repair if the product is faulty, not fit for purpose, or does not match the description. Contact our Customer Service Team to obtain a Returns Authorisation Notice prior to sending items back.

SECTION 9 - INTELLECTUAL PROPERTY AND SECURITY

All materials on the Services, including text, graphics, logos, videos, and software, are owned by or licensed to Two Ants® and Tin Can Solutions Pty Ltd. You may not reproduce, modify, frame, embed, sell, or distribute any material without prior written consent, except for storing or printing copies for the sole purpose of viewing and purchasing products.
Viruses: We do not guarantee that files obtained through the site are free of viruses. You are responsible for scanning any information for viruses, and we accept no liability for any loss or damage caused by malicious code.

SECTION 10 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools and links to external websites. We do not monitor or control these tools and sites and provide them "as is." Accessing third-party materials is entirely at your own risk, and any complaints regarding third-party services should be directed to the relevant provider.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Our store is hosted on Shopify Inc. While Shopify provides the e-commerce platform, your sales and purchases are made directly with Two Ants®. You release Shopify from any claims or liabilities arising from your transactions with us.

SECTION 12 - USER CONTENT, FEEDBACK, AND PROHIBITED USES

You agree that any feedback, reviews, or content you submit ("User Content") may be used by us without restriction or compensation. Your User Content must not infringe on intellectual property rights, be unlawful, defamatory, or contain malware.
You are prohibited from using the site for unlawful purposes, to harass others, to transmit malicious code, to scrape data, or to bypass our security measures. We reserve the right to remove User Content or suspend your account for violating these terms.

SECTION 13 - AGENTS AND AUTOMATED ACCESS

If you deploy an Agent (autonomous or semi-autonomous software) to access our Services, it must identify itself in the HTTP/HTTPS request user agent string (e.g., "Agent/[agent name]"). Agents must not conceal their identity, mimic human behavior, or bypass CAPTCHAs or security measures.

SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct any typographical errors, inaccuracies, or omissions related to product descriptions, pricing, and availability at any time without prior notice, including after you have submitted your order.

SECTION 15 - LIMITATION OF LIABILITY AND INDEMNIFICATION

To the fullest extent permitted by law, and subject to the Australian Consumer Law, Two Ants®, Tin Can Solutions Pty Ltd, and Shopify shall not be liable for any indirect, incidental, or consequential damages, loss of revenue, or loss of data arising from your use of the Services. You agree to indemnify and hold harmless Two Ants® and its affiliates from any claims, losses, or attorneys' fees arising from your breach of these Terms, violation of any law, or misuse of the Services.

SECTION 16 - TERMINATION AND SUSPENSION

We may terminate or suspend your access to the Services immediately if we reasonably suspect fraudulent activity or a breach of these Terms that cannot be remedied. In compliance with Unfair Contract Terms legislation, any unilateral rights to vary or terminate this agreement for convenience will be exercised with reasonable prior written notice. The obligations and liabilities incurred prior to the termination date shall survive termination.

SECTION 17 - SEVERABILITY, WAIVER, AND ASSIGNMENT

If any provision of these Terms is found to be unenforceable, it shall be severed, and the remaining provisions shall continue in full force. Our failure to enforce any right does not constitute a waiver. You may not assign your rights under these Terms without our written consent.

SECTION 18 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that state.

SECTION 19 - CHANGES TO TERMS OF SERVICE

We reserve the right to update or modify these Terms at any time without notice to you. We advise you to check these Terms on a regular basis to stay updated with our Terms. Your continued use of the Services following such updates constitutes your acceptance. We ensure that any changes are fair and reasonably necessary to protect our legitimate business interests.

SECTION 20 - PRIVACY POLICY

Your submission of personal information is governed by our Privacy Policy and Shopify's Privacy Policy. By using our Services, you consent to the collection and use of your data as described in those policies.
